No. 43 of 2004 - Housing (Miscellaneous Provisions) Act Summary Act
What does this law do?
This Act extends the control on the resale of certain dwellings and land. It provides for the local/planning authority placing a claw-back charge or anti-profiteering measure on affordable housing units sold under Part 2 of the Housing (Miscellaneous Provisions) Act 2002 or on houses and land provided under Part V of the Planning and Developments Acts 2000 - 2002.
It will, thereby, allow private financial institutions access to the affordable housing mortgage market and facilitate the direct sale of affordable housing units to eligible persons nominated by the local authority.
